Terms of Service

Welcome to Baby Memories. These Terms govern use of the family-memory storage and sharing service. If you do not agree, please do not use the service.

1. The service

The service provides tools to store, organize, and share family memories, with supporting features such as captions or AI tools when available. Features may change as the product develops. Features that have not launched will not be represented as currently available.

2. Accounts and family administrators

• Provide accurate information and keep information needed to secure your account up to date.
• You are responsible for protecting your sign-in credentials and activity through your account.
• The family administrator controls album settings and sharing permissions within the available features.
• Do not share administrator credentials with people who only need viewing access. Use relative-access credentials where available.
• If you suspect unauthorized access, change your credentials and contact support.

3. Private albums and sharing

An album may be configured for administrator-only access or shared with relatives through a link and corresponding access credentials. Administrators are responsible for choosing recipients, managing access, and considering privacy before sharing children’s photos/videos.

Recipients may take screenshots, save, or forward content they can view. We cannot guarantee that recipients will not copy or reshare content. Do not use the service to upload content that violates another person’s privacy, image rights, copyright, or other legal rights.

4. Content and intellectual property

You retain rights to content you own. You grant us a limited, non-exclusive permission to store, technically reproduce, process, and display content only as needed to provide, protect, and maintain the features you use. These Terms do not transfer ownership of your content to us.

You represent that you have the rights or appropriate basis to upload and share content, including consideration of image and privacy rights of people depicted. You may not upload unlawful, threatening, harassing, child-exploitative, infringing, or otherwise rights-violating content.

5. AI and automated features

AI-generated results may be inaccurate, incomplete, or unsuitable for every situation. Review results before using or sharing them. Do not rely on AI output as medical or legal advice or as the basis for important decisions. AI data processing is described in the Privacy Policy and relevant feature notices.

6. Free and paid plans

During the current development stage, plans and payment methods may not yet be available for purchase. If paid plans launch, prices, feature limits, billing periods, renewals, cancellations, and refunds will be disclosed before purchase. Nothing in these Terms means a price or payment method is currently available unless officially shown in the product.

7. Prohibited conduct

• Accessing or attempting to access an album, account, or data without authorization.
• Sharing passwords, links, or access data to bypass a family’s privacy settings.
• Uploading unlawful, abusive, harassing, child-exploitative, or rights-violating content.
• Interfering with, probing, overloading, reverse engineering, or attempting to bypass service security measures.
• Using the service in violation of law or in a way that creates risk for other users.

8. Reports, restrictions, and termination

We may investigate reports, restrict access, or suspend an account when there is a reasonable basis to believe the account violates these Terms, creates a security risk, or requires action under law. Where appropriate and legally permitted, we will explain the reason and how to request review.

9. Account and data deletion

You can initiate an account deletion request in the app or through the website deletion-request page. To protect the account, we may ask you to sign in again, verify through the registered email/phone number, or provide final confirmation. A request may require manual processing and will be completed within a reasonable period communicated to you. Verification must not be used to unnecessarily obstruct or delay deletion.

Account deletion will cover associated data and content except information that must be retained by law or for legitimate security purposes. If a waiting period applies before permanent deletion, the period and consequences must be clearly shown before confirmation.

10. Availability and limitation of liability

We work to maintain the service but do not guarantee uninterrupted, error-free service or that data loss will never occur. Keep your own copies of especially important photos/videos. To the extent permitted by law, we are not liable for indirect losses arising from use or inability to use the service. These Terms do not exclude liability that cannot lawfully be excluded or limit mandatory consumer rights.

11. Changes to these Terms

We may update these Terms as the service or law changes. The updated version will be posted here with a revision date. Where a material change requires notice or consent under applicable law, we will follow those requirements.

12. Governing law and contact

These Terms apply alongside relevant mandatory legal requirements. If a dispute arises, the parties will try to resolve it in good faith before using the dispute-resolution process available under applicable law.
